Terms of Service

1. Operator

BuyIQ is operated by an Australian private company registered for GST. ABN 35 684 183 471. ACN 684 183 471. References in these Terms to “BuyIQ”, “we”, “us”, or “our” are references to that entity. Operational correspondence is conducted via verdict@buyiq.net.

2. Agreement

These Terms of Service ("Terms") govern your use of BUYIQ (the "Service") operated from Australia and accessible at buyiq.net. By uploading a document, completing checkout, or otherwise using the Service, you agree to be bound by these Terms, the Privacy Policy, and the Disclaimer. If you do not agree, do not use the Service.

The Service is provided business-to-consumer and business-to-business within Australia. Use of the Service is at the age of majority in your state or territory and for your own account. Re-sale, re-badging, sub-licensing, or syndication of any Service output is prohibited without prior written consent.

3. What the Service Does

BuyIQ receives a strata report document uploaded by you, runs it through a locked, source-constrained automated pipeline ("Gold Standard v4.0"), and returns a structured twelve-section Report Summary. Optional specialist briefings — solicitor, negotiation, follow-up — produce additional structured outputs derived from the same source records.

The Service is an informational transcription tool. It is not legal advice, conveyancing advice, financial advice, engineering advice, property advice, or a substitute for any of the foregoing. Every sentence in a Verdict is bound to a single identifiable document within the records you uploaded; nothing is inferred, interpreted, or synthesised.

4. Your Responsibilities

  • You warrant that you have the lawful right to upload the document you submit, and that doing so does not breach any confidentiality obligation, copyright, contractual term, or law.
  • You accept that the Verdict is only as complete as the records you provide. Omitted, scanned-image-only, password-protected, or illegible pages may not be captured.
  • You will not attempt to circumvent, reverse-engineer, extract, copy, scrape, mirror, or inject instructions into the Service, its prompts, or its output pipeline.
  • You will not upload malware, executable code, encrypted archives, or documents unrelated to strata records.
  • You will not use the Service for any unlawful, discriminatory, or misleading purpose.

5. Payment, GST and Refunds

Prices are displayed in Australian dollars. The Instant Verdict is $65 AUD. The optional Audit Assistant is $35 AUD. Payments are processed by Stripe. BUYIQ is a small business operating under the GST threshold; GST is not applicable unless otherwise stated on your invoice.

Refund policy. Because each Verdict is produced on demand and delivered as a digital good, the following rules apply:

  • If the Service fails to deliver a Verdict due to a fault on our side (e.g. processing error, extraction failure, system outage), you are entitled to a full refund on request.
  • If the document you uploaded cannot be processed because it is scanned-image-only, corrupted, password-protected, or not a strata report, we will attempt to notify you; a refund may be offered at our discretion.
  • Refunds are not ordinarily provided where a Verdict has been delivered as specified. This does not limit any non-excludable rights you have under Australian Consumer Law.
  • Refund requests must be sent to verdict@buyiq.net within 30 days of purchase.

6. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the ACL that cannot lawfully be excluded. To the maximum extent permitted by law, our liability for a breach of a non-excludable ACL guarantee is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

7. Intellectual Property

The Gold Standard v4.0 methodology, system prompts, templates, site design, and the arrangement and structure of the Executive Overview are the intellectual property of BUYIQ and protected by copyright and other laws. You receive a personal, non-transferable, non-exclusive licence to use a Verdict you have paid for, for your own purposes connected with the specific property transaction. You may not publish the Verdict for commercial redistribution, nor use it to train machine-learning models.

You retain ownership of the underlying documents you upload. You grant BUYIQ the limited right to store, process, and transmit those documents strictly for the purposes of producing and delivering your Verdict, and as otherwise described in the Privacy Policy.

8. Data Handling and Security

Uploaded documents are stored in encrypted, access-controlled storage. Access to a Verdict is gated by a signed, non-guessable URL. Documents and Verdicts are retained for 30 days unless a longer period is required by law, after which they are scheduled for deletion. We do not sell your data. 9. Third-Party Processors

The Service relies on reputable third-party processors including Stripe (payments), Vercel (hosting and storage), Anthropic (language-model inference), and Namecheap PrivateEmail (email delivery). Each handles data in accordance with its own policies. Use of the Service constitutes agreement to their standard terms as they apply to the limited data they receive.

10. Prohibited Reliance

The Verdict is a decision-support artefact. It is expressly not to be relied upon as the sole basis for any property decision. Before exchange, contract, or settlement, you must obtain independent legal, financial, and technical advice and review the full strata records. We disclaim all liability for any decision made in disregard of this clause.

11. Limitation of Liability

Subject to clause 5 and to the maximum extent permitted by law:

  • The Service is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded.
  • BUYIQ's aggregate liability to you in connection with any claim arising out of or relating to the Service is capped at the amount you paid BUYIQ for the Service in the twelve months immediately preceding the claim.
  • BUYIQ is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of opportunity, loss of data, or loss of bargain.

12. Indemnity

You indemnify BUYIQ against any claim, loss, liability, cost, or expense arising from (a) your misuse of the Service, (b) your upload of a document you had no right to upload, (c) your breach of these Terms, or (d) reliance on a Verdict in contravention of clause 9.

13. Termination

We may suspend or terminate access for any user who breaches these Terms, attempts prompt injection, uploads unlawful content, or abuses the refund process. Termination does not affect accrued rights or obligations.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms.

No personal mailboxes are used for buyer correspondence.
